CLARITY Act Vote Delayed Until September

The U.S. Senate has officially delayed the CLARITY Act vote until September after senators failed to reach an agreement before the August recess. While the crypto market structure legislation still has bipartisan backing, several unresolved issues prevented Senate leaders from moving it forward this week.

Why Was the Vote Delayed?

According to Politico, senators remained deadlocked on several key issues as the Senate prepared to leave for recess.

The biggest roadblock continues to be a bipartisan ethics proposal led by Senators Thom Tillis and Ruben Gallego. Fox Journalist Eleanor Terrett reported that the White House has now started engaging on the proposal after days of discussions, but talks are still ongoing.

At the same time, senators are also working through Bank Regulatory Clarity Act (BRCA) discussions as the White House attempts to address issues raised by law enforcement officials.

Another major sticking point is stablecoin yield regulation. More senators are reportedly seeking changes to the legislation after a recent Wall Street Journal opinion piece reignited debate around yield-bearing stablecoins, giving them additional reasons to push for amendments.

Senate leaders were also concerned that bringing the measure to the floor without enough support could result in a failed cloture vote, potentially damaging months of bipartisan talks.

What Are the Possible Scenarios Now?

With Congress now in recess, the CLARITY Act could move in three different directions.

  • The first scenario is that discussions continue throughout August, allowing the White House and congressional leaders to finalize agreements before the Senate reconvenes in September.
  • The second possibility is that senators return with revised legislative language covering ethics provisions, stablecoin yields, and BRCA-related issues before scheduling another procedural vote.
  • The third scenario is additional delays. Since Congress will reconvene alongside a busy legislative calendar and election campaigning, the measure could struggle to secure floor time if the outstanding issues remain unresolved.

Industry Continues Pressuring Washington

Coinbase CEO Brian Armstrong said the Senate has spent nearly a year working on the CLARITY Act, with senators, regulators, banks, and the crypto industry all making compromises.

Since then, lawmakers have negotiated hundreds of pages of changes, reached agreement on SEC and CFTC nominations, and secured unprecedented ethics commitments. The crypto and banking industry have compromised as well.

He argued that the remaining issue is no longer a compromise but whether the Senate is willing to bring the legislation to a vote, adding that millions of Americans who own crypto are waiting for a resolution.

Meanwhile, some crypto supporters criticized the delay. Investor James E. Thorne called the postponement a victory for the status quo, arguing that continued uncertainty could slow U.S. crypto innovation while other jurisdictions keep moving ahead with clearer regulations.

For now, the crypto industry remains in what one source described to Terrett as a “weird limbo,” with discussions still active but no clear timeline beyond the Senate’s return in September.

Vibes in crypto are mixed at this hour. Many are angry, while others are trying to look on the bright side, hoping Thune will queue up the bill as a priority when the Senate returns in September.

While many are disappointed, others remain hopeful the legislation will become a priority when the Senate returns in September. Digital Chamber CEO Cody Carbone said, “The fight is far from over,” adding that the industry will keep working to build support ahead of the next vote.
